Market Type

Virginia has established a medical cannabis program to allow patient access to prescribed cannabis products.

In Virginia, possession of adult use cannabis is allowed, however retail sales for recreational use are still prohibited.

PMP / BioTrack and Inventory

Virginia leverages a Prescription Monitoring Program to track prescription allotments and patient sales. Additionally, Virginia has established a patient registry with BioTrack, however registration within this patient registry is not mandatory.

Purchase Limits

In Virginia, patient allotments are set by prescription, and so a specific patient’s purchase limit may vary.

Overall, a patient may not purchase more than:
90 days supply of cannabis in a 90 day period
And
No more than 4 Oz. of botanical cannabis in a 30 day period.

Virginia rules do not currently establish or codify any product type equivalencies.

Virginia’s cannabis rules do not create any cannabis specific taxes for medical patients.

  • In the Spring of 2024, Gov. Glen Youngkin vetoed proposed legislation that would have created an adult-use cannabis market in Virginia. Adult Use Cannabis will not be available for retail sale for the foreseeable future.
